Terms and Conditions

§ 1 Scope

For the business relationship between RetrogeR Furniture Art (hereinafter RetrogeR) and the customer, the following General Terms and Conditions in their valid version at the time of ordering apply exclusively. RetrogeR does not recognize any deviating conditions of the customer unless RetrogeR has expressly agreed to their validity in writing.

§ 2 Conclusion of Contract

Your order constitutes an offer to us to conclude a purchase contract. When you place an order on the www.RetrogeR.de online shop, we will send you an email confirming the receipt of your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer but is intended to inform you that we have received your order. A purchase contract is only concluded when we dispatch the ordered product to you. No purchase contract is concluded for products from the same order that are not listed in the shipping confirmation (non-deliverable products). The contract is concluded with RetrogeR. RetrogeR does not offer products for purchase by minors. Our products for children can only be purchased by adults. Please note that we only sell our products in household quantities.

§ 3 Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, took possession of the last goods. To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send the notice of exercising the right of withdrawal before the withdrawal period expires.

Excluded from the right of withdrawal according to § 312 d IV No. 1 BGB are all custom-made products, finishing orders, and customer-specific manufactured items and individual productions, such as individually printed CDs, watches, printed materials, promotional items, etc.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. For audio recordings (such as CDs), the seal (wrapping) must be intact!

End of the Right of Withdrawal

§ 4 Delivery

Unless otherwise agreed, delivery is made from stock to the address specified by the customer. Statements regarding the delivery period are non-binding unless a fixed delivery date has been expressly promised. If, despite a contractual obligation, RetrogeR is not supplied with the ordered goods by the supplier, RetrogeR is entitled to withdraw. In this case, the customer will be promptly informed that the ordered product is not available. The already paid purchase price will be refunded promptly.

§ 5 Due Date and Payment, Default

The customer in Germany can pay the purchase price via PayPal or in advance by bank transfer. Customers outside Germany can only pay the purchase price by credit card. If the customer is in default of payment, RetrogeR is entitled to demand default interest at a rate of 5% above the base rate announced by the European Central Bank per annum. If RetrogeR can demonstrate higher damages due to default, RetrogeR is entitled to claim these.

§ 6 Offset, Retention

The customer is only entitled to offset if his counterclaims have been legally established or are undisputed by RetrogeR. He is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.

§ 7 Retention of Title

The delivered goods remain the property of RetrogeR until full payment has been made.

§ 8 Warranty

If there is a defect in the purchased item, the customer can demand subsequent performance, rectification of defects, or replacement delivery. Unless otherwise specified below, further claims of the customer – for whatever legal reasons – are excluded. RetrogeR is therefore not liable for damages that have not occurred to the delivery item itself; in particular, RetrogeR is not liable for loss of profit or other financial losses of the customer. To the extent that RetrogeR’s liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents. The above limitation of liability does not apply insofar as the cause of damage is based on intent or gross negligence or in the case of personal injury. If RetrogeR negligently breaches an essential contractual obligation, the obligation to compensate for material damage is limited to the typically occurring damage. If subsequent performance is carried out by way of replacement delivery, the customer is obliged to return the initially delivered goods to RetrogeR within 30 days. If the goods do not reach RetrogeR within this period, RetrogeR is entitled to demand a replacement for the initially delivered goods and to debit this from the payment method named for payment. The limitation period is twenty-four months, calculated from the date of delivery.

§ 9 Collection, Processing, and Use of Personal Information of Our Customers

Information we receive from you helps us personalize and continually improve your shopping experience at RetrogeR. We use this information for processing orders, delivering goods, and providing services to buyers and sellers, as well as for processing payments. We also use your information to communicate with you about orders, products, services, and marketing offers, and to update and maintain your customer accounts with us. Additionally, we use your information to improve our store and platform, prevent or detect misuse of our website, or enable third parties to perform technical, logistical, or other services on our behalf.

§ 10 Online Dispute Resolution

§ 11 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
